DTI prompts retailers to adhere to SRPs for basic and prime goods

The Department of Trade and Industry (DTI) prompts owners and operators of supermarkets, grocery stores, wet markets, and general merchandise stores to comply with the specified Suggested Retail Prices (SRPs) for products classified under basic necessities and prime commodities of the Republic Act (R. A.) 7581 or the Price Act.

DTI-Consumer Protection Group (CPG) Undersecretary Atty. Victorio Mario A. Dimagiba affirms, "At this time when speculations on price increases for these goods are rising as an effect of port congestion, the Department reminds retailers to sell their products that are among the basic and prime lists within the SRPs".

"The list of SRPs for basic necessities and prime commodities that we have issued last 02 July 2014 to guide the retailers and consumers, still stands. As of the moment, there are no requests for price adjustments from the industries and the retailers are expected to observe these prices", Undersecretary Dimagiba emphasizes.

Undersecretary Dimagiba explains, "Still, the Department is not discounting the fact that an impact of higher port and other transport charges on imported materials and products is an increase on their prices. In this case, we urge the industry to reasonably recover their added costs, and to which we'll ensure upon evaluation that the increase is appropriate on cost per unit".

In the Senate hearing session on the port congestion issue last Wednesday, the DTI took note that the movement of containers from the Manila ports has been heightened in the past two (2) weeks. Already, the Philippine Ports Authority (PPA) reported that yard utilization at the Manila International Container Terminal (MICT) and the Manila South Harbor was eased up at 90% from the high yard utilization of 110% in June, which was brought by the backlog that resulted from the day-time truck ban. PPA also reported that it estimates the optimum yard utilization level of 70-80% by the last quarter of this year.

These containers hold imported materials and products in boxes that are transported to and from the port by truckers for delivery to manufacturers and importers who distribute them to retailers.

DTI Secretary Gregory L. Domingo states, "The concerned government departments and the private sector are closely working together in crafting short and long term plans to resolve this issue. There is now easing up in Manila ports as the initial plans have been rolled out and we intend to continue this until we subsequently normalize the port operations and trade activities in the Philippine market".

Part of the decongestion plans is the continued port operations on weekends. "The PPA, BOC, and port operators are now working on Saturdays and Sundays to accommodate importers that need to move their containers out of the Manila ports. But we urge more importers to avail and maximize the weekend schedule made available to them", Secretary Domingo appeals.

The DTI conducts regular monitoring activities on the price and supply of basic necessities and prime commodities under its jurisdiction. These products include: basic – canned fish and other marine products, processed milk, coffee, laundry soap, detergent, candles, bread, salt, potable water in bottles and containers, and, locally-manufactured instant noodles; prime – flour, processed and canned pork, processed and canned beef and poultry meat, vinegar, patis, soy sauce, toilet soap, paper, school supplies, cement, clinker, Galvanized iron (GI) sheets, hollow blocks, construction supplies, batteries, electrical supplies, light bulbs, and, steel wires.

Then DTI readies a weekly price monitoring report (PMR) wherein monitored prices based on the SRPs from 16 regions with 79 provinces are consolidated.

In the DTI-Fair Trade and Enforcement Bureau (FTEB) statistics, 50 supermarkets, wet markets and grocery stores were monitored on their status of compliance with the SRPs for basic and prime goods. From 04 to 15 August 2014, only 8% or four (4) of them were found selling up to 5% or P2.50 more than the SRPs. Compared to last month's monitoring activities, DTI-FTEB found 52.13% or 110 of 211 supermarkets, wet markets and grocery stores with prices more than the SRPs of up to 65% or P15.00.

"We have already issued show cause orders to these retailers that we have found selling more than the SRPs for basic and prime goods in the last two (2) weeks of July and first two (2) weeks of August", Undersecretary Dimagiba recounts.

"We will continue to reinforce our monitoring activities on the prices of basic and prime goods so we can prevent undue price adjustments from retailers. We have added more teams particularly in the NCR because more stores are found here but our regional and provincial offices ensure that they also regularly monitor the markets in their areas", Undersecretary Dimagiba relates.

Upon evaluation, if a retailer is found executing illegal acts of price manipulation such as profiteering, which is a violation of the Republic Act 7581 or the Price Act, they shall face an administrative fine of up to P1 million subject to the circumstances provided after due notice and hearing. They can also be criminally liable for illegal price manipulation that may result to imprisonment of not more than 15 years and a maximum fine of P2,000,000.00.

Undersecretary Dimagiba affirms. "DTI is in close coordination with the industry sector to ensure that there is proper notification and consultation prior to any adjustments in SRPs to prevent unnecessary price hikes on basic necessities and prime commodities regularly monitored by the government".

SRPs are issued by manufacturers to retailers to ensure market share and fair competition in the market. Production cost, distribution cost, and profit margins of retailers and distributors are factored in.

 "Incidentally, the DTI observes the existing list of SRPs for Noche Buena products dated 28 October 2013 and will issue the 2014 SRPs by the first week of November 2014", he adds.
